Article Abstract:
The UK government is unlikely to extend the Transfer of Undertakings (Protection of Employment) Regulations (TUPE) to all situations where contracts are reassigned. New contractors may find they are unfairly liable for the wages of workers they don not require but who had been employed by another contracter. The European Union is planning to introduce a directive on the subject of Acquired Rights legislation. TUPE was introduced to protect employees when the work they are carrying out for one company is taken over by another. They are still liable to be made redundant.

Article Abstract:
The UK construction industry should spot the signs of impending problems and face up to them before small issues become large problems which are harder to deal with. Issues can be resolved by using the Construction Act of 1998 which is designed to cover all aspects of the construction industry. Working together as a team reduces the chance of major problems as more people are involved in the individual process which make up the construction of buildings. The Construction Act should be used wisely by all those involved in the construction industry.

Article Abstract:
The case of Ruxley Electronics and Construction Ltd. v Forsyth 73 BLR 1 was successfully used in a legal argument to defend contractors in the case of Freeman v Mohammed Niroomand in 1996 but is not applicable to business contractual law in the construction industry. Various aspects of the Ruxley case were considered during arbitration to weigh up its relevance to the Niroomand case. These are described.
