There are a number of interesting issues related to alternative dispute resolution (ADR) in the UK construction industry. It is important to consider what types of cases judges will regard as appropriate for ADR and which are not. Courts must now oblige litigants to contemplate ADR, and it will therefore become quite normal for a claimant's solicitor to propose ADR to the opponent a long time before court proceedings start. The issue of how much pressure the courts will exert on unwilling parties remains uncertain.

The use of informal methods in alternative dispute resolution (ADR) is seen as a less expensive way of resolving disagreements between parties. The construction industry in the United Kingdom has been slow to make use of the scheme possibly because of the cost and the reluctance of insurers and lawyers to use ADR. It is suggested that the use of ADR will increase the need for lawyers, alternatively a statutory body could be set up to take charge of ADR in the construction industry.

The legal implications of the UK Arbitration Act 1996 are interpreted differently by legal professionals in the construction industry. Many embrace the purpose of the act but doubt whether its objectives can be met. Arbitrators require better training to cope with greater authority, say critics.
