Article Abstract:
The UK Party Wall Etc Act of 1996 rules on how far away from neighbouring property excavations must take place. The ruling states builders must take legal advise before excavating within 6 metres of an adjoining property or structure. County court cases can result from excavating without consulting all parties involved in the building process. Owners of property within 6 metres of an excavation must be informed by the builder, who can be fined for not doing so. Architects may find themselves legally responsible for not informing builders of the need to comply with the Party Wall Act.

UK construction companies should be aware that there can be serious repercussions from ignoring a potential health and safety risk. In law, anyone who suspects a health and safety risk but fails to deal with it is regarded as having known the truth and is therefore held to be negligent. This was the case with Rollco Screw & Rivet, which failed to deal appropriately with brown asbestos contained in the roof of factory premises it took over in Birmingham, England.
