Partnering comes unstuck

The UK construction industry is facing some difficulty in accepting partnering as part of their contracts. Partnering will only work if every member of the contracting team is allowed full information regarding the project and all members of the team are truthful about their expectations for the project. Partnering would help engender a philosophy of collective responsibility to find solutions and share costs from faulty workmanship. Contractors tend to look for someone else to blame, if a fault occurs during construction work, which can lead to protracted legal proceedings.

It can be argued that main construction contractors in the UK should consider abandoning their in-house subcontracts, which often contain unfair clauses, as the construction industry shows a greater desire for cooperation and conflict avoidance. It would be much fairer if main contractors were to use unamended standard subcontracts. However, it is also possible to argue that it would be very impractical for main contractors to use standard subcontracts in many cases. Furthermore, main contractors must be able to pass on the terms of the main contract to subcontractors.

Standard practice
Article Abstract:
The UK construction industry has not adopted the New Engineering Contract as proposed by Sir Michael Latham because its standard format is not appropriate or flexible enough to suit every contractual need. Latham was attempting to rationalise the unacceptably high number of construction contracts in the UK. The European Commission is looking at other ways of improving standards within the industry.
