No ban on 'on-frame' modulars, N.C. Supreme Court rules
Article Abstract:
The North Carolina Supreme Court has established that on-frame modular homes may not be banned in a subdivision just because they are transported to the site on wheels and axles. The ruling emphasized that the method of delivery does not count as long as the home satisfies the North Carolina building code requirements and is sited on a permanent foundation. Also, subdivision rules on mobile homes and trailers cannot be applied to modular homes. The case involved the modular home of Edward and Margaret Rankin delivered to a lot in Chatham County, NC.
