Novation without tears

Article Abstract:

Novation occurs when a clients' contract with a building consultant is passed on to the contractor. Novation must be carried out before detailed design work commences. Novation documents must be constructed carefully. Poorly constructed novation contracts may end up in the courts. Partial novation can lead to consultants finding it difficult to decide in whose interest they are working. Novation is popular with design and build clients who find they are able to have the services of the consultant before and after novation but the contractor holds responsibility for the work.

The PFI's poisoned chalice

Article Abstract:

An independent certifier of Private Finance Initiative contracts should ensure their professional indemnity insurers cover the high risks in their work. It may be possible to agree to a maximum liability of no more than 25 million pounds sterling. They must also ensure they charge sufficient fees for the time spent in reviewing a third party's work. Their role should be clearly defined and agreed before they start working on the contract. The certifier is liable to be sued instead of the primary performer.

Ready for inspection

Article Abstract:

Advice for building inspection consultants on how to formulate their terms of work with their clients is presented. Their clients should be aware the consultants cannot be expected to find every fault during the inspection process.
