Practical issues

Article Abstract:

The workshop on practical completion held by Overbury raised a number of interesting points. Participants considered whether US practice relating to practical completion could provide any valuable examples, and raised a number of points about differing standards of completion and differences in client expectations. It was agreed that the health and safety file should be in place at practical completion and that the use of negotiated punch lists, as in the US, could prove beneficial for all parties.

Tussling over float and contingencies

Article Abstract:

Building contractors usually claim that they own the float of a building contract and should be granted an extension of time if the float is used because of contract delay. Contracts vary. Very often a contractor will have to use up the float before an extension of time is allowed. Financial contingencies included in the contract sum are owned by the contractor if they are included in the rates or included as separately priced items.

Consultants face damages dilemma

Article Abstract:

A property developer whose housing development was delayed by an architect's negligence was able to successfully claim damages based on compensation for the fall in value of the homes caused by the property slump. The case may not have widespread implications because of the difficulty of proving delay caused by a consultant's negligence.
