Procurement and the PFI

The private finance initiative (PFI) was introduced almost four years ago, but there is still uncertainty about placing adverts in the European Union's Official Journal, relating to the category of contracts and the award procedure. Some contracting authorities advertise the contract in both the works and services sections of the Official Journal, but it can cause difficulties in establishing criteria. Contracting authorities should generally use the open or restricted procedure when awarding contracts, although the negotiated procedure lends itself more to PFI projects.

Amendment 18 to the UK construction industry's JCT80 standard contract is very lengthy and particularly confusing concerning the final certificate. The final certificate used to be conclusive on issues related to the contract. However, Amendment 18 appears to permit adjudicators and courts to set aside final certificates and make a ruling on disputed issues as if the final certificate did not exist. Parties using Amendment 18 may prefer to add an additional clause to avoid doubt.
