Article Abstract:
A recent judgment by the European Court of Justice highlights the possibility that UK regulations on obtaining damages for breach of European procurement regulations do not accurately implement the relevant directive. In the case of Alcatel et al, it was ruled that the directive was to be interpreted as obliging member states to ensure that a contracting authority's decision before the formation of a contract was open to review. There must also be the opportunity to set aside this decision if necessary.
