Why adjudication is illegal
Article Abstract:
The Human Rights Act 1998, which became law in Nov 1998, is set to have a significant impact on the adjudication procedures developed by the UK construction industry under the 1996 Construction Act. The 28-day time limit for a decision set down by the Construction Act will often infringe the requirement of the European Convention on Human Rights, which is incorporated in the Human Rights Act, that each party has the opportunity to put its case under fair conditions. It is unlikely that the provisions of the Construction Act will produce decisions regarded as fair under the convention.

UK government construction projects are expected to run more smoothly with the change from public finance initiative (PFI) funding to public-private partnerships (PPP). The public sector is seeking to play a more centre role in PPP projects, enabling firms to have a greater say in how a design is implemented and how working practices are carried out. Designers need to protect against losses by employing cost controls and using liability caps against disputes occurring.
