Reforming the residential mortgage foreclosure process
Article Abstract:
Inequities in the mortgage foreclosure process could be mitigated by allowing Dutch auctions with revelation of the mortgage bank's bid price. Under the current system, the banks' superior access to information enables them to bid for foreclosed property at less than the value of the outstanding loan, resulting in deficiency judgments against homeowners. Dutch auctions, in which homeowners or their agents can gradually lower the asking price until either a bank or a third party makes a bid, would at least partly correct the existing unfairness.
