The concept of "down-zoning" in land use planning
Article Abstract:
Local governments have the right and obligation to re-zone cities for various health, safety or public welfare needs using the concept of down-zoning. However, down-zoning is often criticized as an unreasonable confiscation of land value without an avenue for reimbursement. Therefore, local governments planning to use down-zoning must evaluate the circumstances and determine whether the public benefit outweighs the land use rights of property owners.
