Flow control and waste import bans
Article Abstract:
The US Supreme Court ruled that state flow control statutes and waste import bans violate the dormant Commerce Clause of the US constitution because it restricts and prohibits interstate commerce. These waste import bans were legislated by the states because they still put a negative utility value on solid wastes. The flow control statues, on the other hand, which prohibits the export of solid waste into other states, were legislated not because solid waste has recently acquired utility value but because of the positive utility value of the state's reliable waste management systems.

Solid waste flow control update
Article Abstract:
Municipal and environmental authorities were able to appeal to Congress to rescind a decision made in 1994 declaring flow control laws unconstitutional. It responded by approving a bill that regulated both waste disposal site regulation and interstate waste management contracts. The bill has yet to pass in the Senate and may face opposition from the House Committee Commerce chairman. Waste bond financing agreements may also be reevaluated if the bill fails to pass in the federal legislature.

Article Abstract:
The state of Virginia and New York City are at loggerheads over the dumping of New York City waste in Virginia landfills. Waste imports in Virginia have doubled since 1997 and the situation reached crisis proportions with owner of five landfills in Virginia, Waste Management's decision to up waste disposal activity in Virginia. A similar case heard in 1994, which ruled against a waste control statue, is examined.
