The False Claims Act as a remedy to the inadequate provision of nutrition and wound care to nursing home residents
Article Abstract:
Government enforcement of the Nursing Home Reform Act (NHRA) and the federal False Claims Act can push long term care facilities to meet legal standards of patient care. The NHRA requires long-term care facilities provide quality physical and mental care to residents. Facilities which participate in Medicare and Medicaid must meet similar requirements or possibly face prosecution under the regulations of the False Claims Act. Awareness of the legal implications for long term care facilities arose following a US government action against a Pennsylvania facility.
