Article Abstract:
An analysis of the legal developments is conducted in three major common law countries faced with balancing against national security concerns, the issue of a political refugee's right to be free from deportation to a country where there is a fear of torture or death and whether or not deportation under such circumstances is consistent with their obligation under international law. It is argued that it is simply unacceptable to return an individual to a country where he or she may be tortured.
