Article Abstract:
United States v. Kai-Lo Hsu shows the difficulty of balancing the constitutional rights of defendants in an economic espionage action with those of businesses not to have their trade secrets disclosed. This action concerned alleged bribery of Bristol-Myers employees to obtain trade secrets about the production of Taxol. High technology companies' alternatives for trade secret protection in the absence of an effective federal law enforcement solution are listed.
