A new test for Lemon; will the courts give a passing grade to school vouchers?
Article Abstract:
The 1998 Wisconsin Supreme Court case of Jackson v. Bennion ruled that educational vouchers did not violate the First Amendment's establishment clause, since they gave money to parents who just happened to spend it on church schools. Civil libertarians argue that the parental choice mechanism is just a gimmick to subsidize religion, but what drives Milwaukee's voucher experiment and others across the US may be parental frustration at public schools' seeming inability to provide high-quality, safe education.

'Weighty reasons' for secrecy; effort to acquire posthumous notes spurs attorney-client privilege ruling
Article Abstract:
The US Supreme Court ruled in Swidler & Berlin v. United States that attorney-client communications remained privileged after the client's death, and the ABA was among the groups encouraging such a holding. The case regarded whether Independent Counsel Kenneth Starr could obtain notes of a conversation between former White House Counsel Vincent Foster and his lawyer just days before Foster's suicide in 1993.

A crack in the wall; does First Amendment separate church and Alabama?
Article Abstract:
Alabama Gov Forrest H. James Jr. is arguing that the US Supreme Court cannot keep Alabama students from praying in school since First Amendment guarantees of free speech and religion do not apply to the states. Constitutional law expert A.E. Dick Howard states this argument is discredited and is skeptical it will work, even though the Court has become less tolerant of federal intrusions into state affairs.
