'Absence-control' plans can unleash litigation; attendance can't be inequitably enforced

Article Abstract:

Some employers have responded to the sluggish economy and increased competition by instituting 'absence-control policies.' These can be an incentive for good attendance as well as reducing workflow disruptions caused by employee absenteeism. Employers must plan these policies carefully, however, in order not to risk discrimination suits by pregnant or disabled employees discharged for absenteeism. Courts have generally recognized neutral absence-control policies, it is discriminatory application which gives rise to litigation.

Securities litigation: reform misses mark

Article Abstract:

Reforms of securities litigation passed or under consideration in Congress go either too far or not far enough and lack the most effective mechanism to aid investors. This would be to limit recovery in most class-action fraud-on-the-market cases to some factor derived from the wrongdoers' anticipated gains. As it is, the two sides debating reform include class-action lawyers and businesspeople, but exclude the investors who pay for most lawsuits and who ultimately, despite the law of averages, lose on such transactions.

Hope for out-of-style liberal litigation

Article Abstract:

Labor/Community Strategy Center v. Los Angeles Mass Transit Authority is a federal district court case which at first glance is about providing equal facilities to all socioeconomic levels of mass transit users but is really about much more. The center is a grass roots movement dedicated to solving the environmental, civil rights and employment problems of poor and working-class people. The center wishes to fight the suit in court as a way of educating the public about such problems.
