The author discusses the U.S. Court of Appeals for the Federal Circuit's decisions in State Street Bank & Trust v. Signature Financial Group and AT&T Corp. v. Excel Communications, Inc. and the appropriateness of extending the boundaries of subject-matter patents.

The future of prior appropriation in the new West
Article Abstract:
Prior appropriation is a water allocation system that allowed private ownership of water rights with some sharing requirements in scarce times. This article reviews the strengths and weakness of this old scheme and considers reasons for its decline.

Business method patents - a matter of convenience?
Article Abstract:
Case law and patent law in Australia both point to the fact that business methods should be patentable.? This would have beneficial effects and would not have the disadvantages often claimed for it.
