Business interruption insurance baffles claimants: not grasping the nature of the coverage, many think they have tort-like claims for lost profits
Article Abstract:
Most disputes over business interruption losses are factual disputes on business issues, such as the projection of lost business. Such disputes can involve accounting theory and other complexities and be poorly suited to jury trial. Appraisal, a form of dispute resolution most often mandated by law in standard fire insurance policies, has become popular in business interruption disputes in view of this complexity. In some cases, the losing party has challenged the results of the appraisal but most business interruption claims can be resolved once the coverage is understood.

Health-care reform is a major issue for 'TIPS.' (Tort and Insurance Practice Section) (ABA/NYC)
Article Abstract:
The ABA's Tort and Insurance Practice Section (TIPS) includes defense, corporate, regulatory, insurance and plaintiffs' attorneys and executives among its 32,000 members. The section deals with insurance and tort issues in both the commercial and regulatory areas. The section's 1993-94 agenda includes a study of the Clinton administration's recommendations for health care reform, especially the recommendations concerning insurance issues. TIPS is also evaluating recommendations for civil justice reform, including a revision of ABA rule 3.6 on trial publicity.
