Buyers should look out for IRS estate tax liens; property formerly owned by an estate may have a 'hidden' lien

Real estate attorneys for those who buy real property from estates should be aware that a special tax lien under IRC 6324(a)(1) may attach to the property, even if the buyer has obtained a title commitment showing no liens against the property. Such liens attach to an estate at the time of the decedent's death and run with the estate's land until it is divested, even if the land goes to a bona fide purchaser for value. If a certificate of discharge is not forthcoming, the issue is whether the code's divestment provision allows the buyer to safely proceed.

Criminal defense is often a one-night stand
Article Abstract:
Criminal attorneys are required to act as advocates for their clients, even though the public may have a low opinion of the individuals being defended. A criminal attorney recalls conflicting arguments he made on behalf of clients in different but related trials, and his justification for doing so. The judge's attitude in the case implied defense attorneys must be bound by previous positions taken, rather than allowing them to mount the best defense for the present client.
