Article Abstract:
Proper drafting of estate planning documents can help to take full advantage of the estate tax marital deduction and ensure continued tax deferral for benefits accrued in qualified plans and individual retirement accounts. Lump-sum distributions may qualify for inclusion in the marital deduction, and spousal rollover of plan distributions may also be available. The use of qualified terminable interest property trusts may assist in qualifying funds for the marital deduction. Flexible designations or qualified disclaimers may be effective for ensuring that the unified credit is not underfunded.

Roth IRA or regular IRA: how to decide which one is preferable
Article Abstract:
The Roth Individual Retirement Account (IRA), created by the Taxpayer Relief Act of 1997, can be a significant tool for transferring and building wealth. This new kind of IRA differs from the traditional retirement account by accepting contributions from after-tax dollars, by all of its distributions possibly qualifying as free from taxes, and by distributions not being made until after the owner's death. If a client does not need proceeds from an IRA for retirement income, the Roth IRA should be considered as a means to transfer wealth to the next generation.
