DART is aimed at construction bulls-eye
Article Abstract:
The Dispute Avoidance and Resolution Task Force (DART) has in its first three years effectively reached much of the construction industry, promoting ways to address the roots of conflict. At a conference on Oct 16-19, 1994, results of a worldwide survey on DART were presented, indicating the wide acceptance of dispute resolution but limited awareness of it among certain sectors of the industry. Mediation and partnering received the highest marks for effectiveness. Allan D Silberman is DART's new executive director.

Supreme Court: FAA preempts state law on the question of punitive damages
Article Abstract:
The US Supreme Court has ruled that an arbitral agreement of punitive damages takes precedence over state law allowing only the courts, and not arbitrators, to award such damages. The majority opinion wrote that New York's contractual choice-of-law provision precludes arbitral awards of punitive damages that would otherwise be proper.

Arbitration in the building industry in the Netherlands
Article Abstract:
Thee Dutch business world has long recognized the need to expedite the resolution of commercial disputes and has created arbitration facilities within many business organizations. The court of arbitration for the building industry and the Netherlands Arbitration Institute are the best-known arbitration institutions in the country.
