Disclosing "lobbying" activities: a critical examination of the Federal Regulation of Lobbying Act and the Byrd Amendment
Article Abstract:
Congress is considering consolidating existing lobbying regulations into one piece of legislation, the Lobbying Disclosure Act of 1993. The proposed act would encompass the Lobbying Act enacted in 1946 and the Byrd Amendment of 1989. Lobbyists have constantly abused the original Lobbying Act, assuming it applies only to lobbying members of Congress and not their staffs. Compliance is assumed to be voluntary, but the language of the Act suggests it is a matter of criminal law. The Byrd Amendment regulates government contractors, limiting their ability to lobby both Congress and the executive branch. Problems with existing lobbying law and compliance are discussed.

Prosecutorial discretion and agency self-regulation: CNI v. Young and the aflatoxin dance
Article Abstract:
The Community Nutrition Institute v. Young line of cases exemplifies the tension between the two conflicting models of administrative law. During the litigation, the D.C. Circuit espoused the older model, with limited administrative discretion, strict formality and frequent judicial review. The Supreme Court favored the newer model, with executive rather than judicial oversight and greater administrative discretion.
