Expiration of retiree benefit plans during reorganization: a bitter pill for employees
Article Abstract:
The Retiree Benefits Bankruptcy Protection Act and Bankruptcy Code section 1114 have been interpreted as requiring debtor-employers to continue funding employee retirement benefit plans as a condition to corporate reorganization only if the labor contract providing for such benefits extends beyond, and does not terminate during, the debt relief period. Future disputes over an indebted employer's duty to continue benefits funding should be controlled by labor laws protecting unionized employees from unfair labor practices. Collective bargaining must precede labor contract modification or renewal.

The local reponse to tax limitation measures: do local governments manipulate voters to increase revenues?
Article Abstract:
State tax limits can result in cities managing their economic policy in order to motivate voters to overturn the tax caps. Cities do this by making large cuts in visible services. This is especially true in cities where tax limits can be overridden in local referendums.
