Federal securities arbitration: does it provide adequate relief?
Article Abstract:
Recent cases suggests arbitration can provide adequate relief to investors who are involved in federal securities investment disputes. This counters the long-held assumption that investors are not likely to be adequately compensated in such cases and are restricted in their avenues of recourse. While it is true that arbitrators have historically been more kind to big business, including securities firms, than small-time investors who lose their life savings, statistics show that more investors are receiving what they consider just awards from arbitrators. The case history and federal laws surrounding the issue are discussed.

Article Abstract:
The Florida New Motor Vehicle Arbitration Board has proven beneficial to consumers since its inception in 1989. The board is charged with implementing the state's lemon law. While arbitration has helped resolve many complaints, there are some flaws. Consumers often fail to successfully present their cases, not realizing they must do more than demonstrate a defect. Manufacturers also have problems with the procedure. Arbitrator effectiveness can also be improved through better training.
