Fusion candidacies, disaggregation, and freedom of association
Article Abstract:
Judicial approval of state bans on fusion in elections is a violation of freedom of association and voting rights that creates an insurmountable barrier to third party candidates. To allow fusion is to allow voters to select a candidate that is affiliated with more than one party, with those parties identified on the ballot. Allowing voters to select fusion candidates would enable third parties to develop an enduring presence. Allowing fusion would also raise questions of whether votes can be disaggregated to identify voter selection of party affiliation as well.
