Keep off the grass: prohibiting nonemployee union access without discriminating
Article Abstract:
Courts and the National Labor Relations Board (NLRB) take inconsistent positions on the issue of employers' right to exclude nonemployee union representatives from their premises. The general law is that exclusion is allowable if other reasonable means of access to employees exist and if discrimination does not exist. The NLRB and courts differ in their definitions of discrimination, such as the weight given to quantity or quality of alleged comparative activities. The NLRB should take a modified approach to this issue which would take into account union and employee rights as well as employer property rights.

The practice of peer review in the international nuclear safety regime
Article Abstract:
A two-tiered system of nuclear power plant safety has developed internationally as regulation and the will to make regulatory commitments has grown over time. The Convention on Nuclear Safety operates at the national level through state compliance with the provisions of the treaty. Peer review, operating at the organization level, functions to promote compliance with nuclear safety standards through collegiality. The organizational peer review efforts effectively supplement the legal norms established under the Convention.
