'Practice management' raises legal questions; federal, state laws govern transactions that transfer physicians' administrative practice duties to a third party for a fee
Article Abstract:
Practice management is one of the fastest growing areas of the medical industry and a practice manager does both administration and managed care contracting assistance. The growth in the area can be ascribed to the fact that doctors need expert health in view of Medicare cutbacks and the nationwide ascendancy of managed care, and most doctors would rather focus on the practice of medicine and leave management to others. Practice management companies can be publicly traded and the terms of the financial arrangements practice managers offer differ widely. Stark and anti-kickback rules can be implicated.

Product labels; when 'made in U.S.A.' is ok; after re-adopting old standard, FTC has issued comprehensive guidelines for interpreting it
Article Abstract:
The Federal Trade Commission has relaxed its guideline for products meeting the 'made in the U.S.A.' label. In May 1998 the agency asked for public comment on allowing products where "substantially all" of the material and labor costs were of domestic origin to carry this label. The agency apparently felt the old standard did not reflect the global economy, in which manufacturers freely use foreign input vendors and products are partially made in several locales. The public and key legislators objected to the relaxation, however, and the proposal was abandoned.
