Reforming jury practice in patent cases: suggestions towards learning to love using an eighteenth century system while approaching the twenty-first century
Article Abstract:
Patent cases are overly burdened by the constitutional guarantee of a trial by jury, but there are several steps that be taken to minimize the impact of juries in patent disputes. These include using pre-trial Markham hearings, using in lumine motions to decide evidence-related issues prior to trial, bifurcating trial proceedings, limiting the issues to be presented before the jury and deciding ahead of time what the jury charge will be. Others recommendations are included.

Planning a global patent strategy to maximize value: where to get the most "bang for your buck."
Article Abstract:
Some countries offer more valuable patent protection than others, based on the cost of patent applications and the prospective return on that cost, determined by the number of consumers, length of protection and the likelihood of competition. As a cost-benefit decision, the most valuable places to have a product patented are the United States, India, the UK, Canada and Japan. Patents may not be worth the money in places like Luxemburg, Denmark and Panama.
