Statutory stoplights; automatic stays bring new balance to divorce actions

Article Abstract:

Illinois has joined the list of states including automatic stay provisions in their divorce statutes. The Illinois Marriage and Dissolution of Marriage Act provides automatic stays against three types of conduct, including transfer or disposition of property without consent of the other spouse or court approval, physical abuse or harassment, and hiding children or moving them across state lines without spousal consent or court permission. Automatic stays do not require a showing of cause. Supporters maintain they protect parties to a divorce against unfair acts by their spouses.

Speedy justice and timeless delays: the validity of open-ended "ends-of-justice" continuances under the Speedy Trial Act

Article Abstract:

A 'reasonable relation' standard should govern the duration of 'ends-of-justice' continuances under the Speedy Trial Act. According to the 'reasonable relation' approach, the duration of a continuance should be related to the rationale for the continuance. Continuances should be open-ended only when justified by the rationale, and when an end date cannot be fixed. In addition to the 'reasonable relation' approach, courts have applied the 'definite duration' approach and the 'reasonable duration' approach.

Patents for products intended to deter terrorism which came out after the World Trade Center and Pentagon attacks are discussed. Anti-terror creations and those intended to save energy already qualify for priority consideration by the Patent and Trademark Office.
