The Attorney-General's Department's moral rights discussion paper: background and proposals
Article Abstract:
The Australian Attorney-General's Dept is exploring the implementation of moral rights to give authors' some claim and control over their copyrighted works beyond economic rights. These rights include preserving the integrity of the work and authorship attribution, already required by the Berne Convention, as well as control over the public release including the withdrawal of the work from the public. Support for moral rights is sparked by international recognition and responds to technological advances while opposition is from the film industry. Implementation remains problematic.

The race for possession: the rights of retention of title suppliers of fixtures
Article Abstract:
Suppliers of goods which can become fixtures face the difficulty of overcoming the doctrine of fixtures when trying to recover for loss when buyers do not pay, even with a retention of title clause in their contracts. Steps suppliers can take to protect themselves include conducting a risk-benefit analysis, taking out a purchase money security interest in the land, and drafting retention of title clauses so they confer an equitable interest. They may also try to press claims of unjust enrichment.

Securing consumer credit card accounts with goods purchased: celebration of freedom or exercise in bondage?
Article Abstract:
Credit card issued by major retailers such as Montgomery Ward and Sears often use the goods purchased with them as security. That is, the retailer reserves the right to use the goods to recoup at least some of its loss if the purchaser defaults and files for bankruptcy. Utilitarians, who favor secured credit card accounts, have long debated with paternalists, who object to them as unconscionable and incompatible with the fresh start bankruptcy policy.
