Injunction to restrain dismissal in breach of redundancy selection procedure
Article Abstract:
The Court of Session in Anderson v. Pringle of Scotland Ltd. held redundancy methods can be incorporated into an unwritten employment contract despite the express renouncement in a union employment agreement of those methods as being enforceable contract rights. Further, the court upheld an interim interdict against the employer ordering the use of those methods rather than the employer's preferred redundancy methods which could have terminated plaintiff's employment. The court stated the company should be held to the terms of its own bargain regardless of potential damage to the relationship.
