Enforcement of subrogation provisions in employee benefit plans
Article Abstract:
Employee benefits plan administrators need to carefully draft subrogation clauses, where the plan does not have to pay on medical expenses covered by a third party, because enforcement is subject to individual court opinions. ERISA does not directly address subrogation, leaving federal courts with the choice of which law to apply, whether state or federal. Some important issues include minors as injured parties, who is the defendant, limits on recovery and obligations and consideration.

Article Abstract:
The role of technical assistance centers in dealing with employer concerns about employing deaf or hearing-impaired workers is discussed. The Job Accommodations Network, the 10 regional Disability and Business Technical Assistance Centers and the state-level Assistive Technology Projects are among these centers.
