The privatization-nationalization cycle: the link between markets and ethnicity in developing countries
Article Abstract:
Advocates of privatization in developing countries have failed to consider the historical reality that many nations have cycled between privatization and nationalization because of the effects of markets and ethnic conflicts. Latin American and Southeast Asian nations in particular have had alternating periods of increased state ownership and increased private ownership. To implement privatization as an enduring characteristic of these economies, policymakers must determine how to address ethnic considerations and economic justice issues in the transition to privatization.

State settlement class actions that release exclusive federal claims: developing a framework for multijurisdictional management of shareholder litigation
Article Abstract:
The recent development in state class action suits for shareholders allowing for a settlement in which members must release all claims including those on the federal level is problematic. Not only does this development limit members' due process rights, but it also creates a potential for misconduct since the attorneys advise the members on the settlement and so can be influenced by the promise of high fees in the settlement. The relinquishment of federal rights in a state court also requires the courts to address unfamiliar issues.

Recent developments in securities class action and shareholder derivative suits: a review of legal reform legislation and significant cases
Article Abstract:
Congressional concerns about abuses in securities class action and shareholder derivative suits has led to the pending legislation called the Private Securities Litigation Reform Act of 1995. Court decisions affecting such suits have covered statute of limitations issues, settlements, third party liability, and pleadings of causes of action. SEC regulatory developments are also discussed.
