Transfer regulations preclude consensual variation of contract
Article Abstract:
The Employment Appeal Tribunal, in its Wilson decision, holds consensual variations in transferred employees' employment conditions are prohibited, a conclusion that could affect many other transfer situations. The EAT said the key issue is determining if the transfer is the reason for the variation. Employees cannot affirm the varied terms by continuing work if there is any causal link between their transfer and the variation.
