Unionization efforts in banking: is the Delaware experience a guide to the future?
Article Abstract:
Labor unions tried and failed four times to unionize bank employees in Delaware during the 1980s. However, attempts at unionizing are intensifying in the recession-plagued 1990s, with employee dissatisfaction on the rise due to layoffs and restructuring. The failed unionizing attempts were made by the United Food and Commercial Workers, by the Communications Workers of America and by the Delaware Bank Employees Assn, which billed itself as an advocacy group rather than a union.

The NLRB's decision in Dubuque Packing Co sets a new standard for collective bargaining on work relocation decisions. The union alleged that management refused good-faith bargaining and information about the decision to transfer part of its operations to a nonunion plant, and the NLRB ruled that management had a duty to bargain on plant relocation, balancing a company's bargaining duty and its need for control over the management of the business.

The relevance of ratification elections to a union's presumption of majority status after merger or affiliation
Article Abstract:
Section 9 of the National Labor Relations Act mandates a formal election to resolve questions of whether or not a union is an appropriate representative. The Supreme Court has ruled that corporate reorganizations necessitate a Section 9 election, and that an informal ratification vote is not a worthy substitute. The court has also ruled that non-members do not have to be included in a vote to ratify corporate reorganization.
