When should computer owners be liable for copyright infringement by users?
Article Abstract:
Existing standards for vicarious and contributory copyright infringement should be applied to computer bulletin board and network operators to address the infringement threats posed by such networks. Imposing such liability is appropriate because it strikes a balance between the interests of copyright owners and society, because network operators control the computers and because they are in the best position to distribute costs among users. Their liability is analogous to dance hall owners that benefit financially from the customer draw that results from copyrighted music being played.
