NBA v. Motorola and Stats, Inc.: the Second Circuit properly limits the "hot news doctrine."
Article Abstract:
The US Court of Appeals for the 2d Circuit dismissed in National Basketball Ass'n v. Motorola, Inc. the plaintiff's claim that using real-time sports data from its games violated federal copyright law. The plaintiff had argued that using real-time game statistics without the league's consent violated the law. The Court, however, held that Motorola and STATs, Inc's use of game statistics did not misappropriate NBA property under the hot news doctrine.
