Rating Internet content and the spectre of government regulation
Article Abstract:
Congress should take no further action on Internet content after the US Supreme Court's finding unconstitutional the Communications Decency Act in Reno v. ACLU. Any governmentally regulated voluntary rating system for Internet content seeking to protect children from potentially corrupting material would probably fail judicial strict scrutiny tests for 1st Amendment free speech rights. Parents can control their household's Internet content with content-blocking software without Congress limiting the free flow of information using a content-based rating systems.

Mapping legal metaphors in cyberspace: evolving the underlying paradigm
Article Abstract:
The proper legal metaphor for regulating the Internet is as a commonly shared community resource such as the town commons. This metaphor forces attitudinal shift from viewing cyberspace as an organic entity versus a collection of mechanical items. Such models promote regulating cyberspace based upon property rights and market forces especially since the Internet by its nature defies centralized governmental control.
