Data mines and battlefields: looking at financial aggregators to understand the legal boundaries and ownership rights in the use of personal data
Article Abstract:
Laws applicable to the use of data-mining and customer profiling techniques by Internet-based financial aggregators are outlined. An overview of the technology that allows the aggregation of data of a customer's accounts with financial institutions, stockbrokers, and frequent flyer programs is provided.

This article consists of a bench memorandum and two briefs produced in a moot court competition. The case at issue involves the tort liability of a world wide web archive that published damaging personal information originally placed on another site by hackers.
