Court allows suit based on vague identification

The Massachusetts Supreme Judicial Court has ruled that sufficient evidence was presented to withstand a dismissal motion in a libel suit filed by the owner of a Brookline, MA, deli, who claimed a Boston radio station referred to him as a drug dealer in a news broadcast of a drug ring arrest. The radio station argued that the case should be dismissed because the name of the deli and those arrested were not identified, but the court said dismissal was for a trial court to decide.

Court upholds dismissal of Business Week suit
Article Abstract:
The US Court of Appeals for the 3d Circuit upheld the US District Court of Pennsylvania Western District's dismissal of a libel suit against McGraw-Hill Inc. The parties had agreed to try the case under New York law, which requires proof of 'gross irresponsibility' in libel cases, but the district court ruled that the evidence showed that the reporters had performed their jobs responsibly, and dismissed the case for lack of grounds. The appellate court agreed.

Court upholds dismissal of civil rights suit
Article Abstract:
The US Court of Appeals for the 9th Circuit ruled that Peggy McMartin Buckey's civil rights claim and libel suit against Capital Cities/ABC reporter Wayne Satz and child abuse investigator Kathleen MacFarlane was properly dismissed. The court stated Buckey's claim against the state of California for conspiracy with the news media to deprive her of her business and teaching license was proper, but that her due process and defamation claims were not.
