Judge bars naming juvenile sex crime victims
Article Abstract:
The Illinois Supreme Court has ruled that the state's Juvenile Court Act does not restrict the news media's access to juvenile proceedings, but it does not authorize the media to reveal juvenile sexual abuse victims' identities, either. The majority of the court stated that minors have a right of privacy under the state's Constitution and that right must be balanced against the press' right of access. A dissenting opinion argued that it was a form of censorship to allow the press access but not allow them to publish information they lawfully obtained.

State law banning identification of sexual assault victims ruled unconstitutional
Article Abstract:
The Florida Supreme Court invalidated a state law barring publication of the names or faces of sexual assault victims in Florida v. Globe Communications Corp. on freedom of speech and underinclusiveness grounds. The Court found that liability from victims' identities cannot be automatic and can only be on a case-by-case basis. The statute was also underinclusive because it only applied to media organizations even though individuals could also cause the victims harm by releasing their identity.

Ban on naming rape victims unconstitutional
Article Abstract:
A Florida county trial court has declared the state law which prohibits the publication of rape victims' names unconstitutional and dismissed criminal charges against the Globe, the tabloid that published the name of the woman who accused William Kennedy Smith of rape. The court dismissed the case in Oct 1991, ruling that the law was overbroad and defective for not providing for hearings to determine whether the facts of each case require restriction of the press' constitutional rights.
