Claim alleging 'negligent hiring' of disc jockey dismissed
Article Abstract:
The Illinois Supreme Court, in Van Horne v. Muller, rejected plaintiff's claim for 'negligent hiring' while allowing his defamation claims to go to trial. Keith Van Horne, a radio personality, brought the claims against Matthew 'Mancow' Muller, another radio personality. The Court declared that, although a negligent hiring cause of action does exist in Illinois, Van Horne's inability to link Muller's alleged unfitness to the damages he caused made Van Horne's claim unsupportable.
