Loewen invokes NAFTA clause
Article Abstract:
Loewen Group Inc., the Canadian funeral firm, is invoking a NAFTA provision that allows firms to recover losses incurred through the actions of state or provincial governments. The company is alleging that a jury verdict in a Mississippi court that resulted in a $500-million award in 1995 to the O'Keefe family against the company, was grossly unfair and was responsible for the downfall of the company. Loewen's petition will be heard by the Washington DC-based International Centre for Settlement of Investment Disputes, a unit of the World Bank.
