NOL carryovers
Article Abstract:
Guidelines are presented on how to compute the 1995 net operating loss (NOL) that can be carried over by an individual to 1996 if the right election to drop the carryback is taken. The first step requires calculation of the individual's adjusted gross income (AGI) by adding the wages, Schedule C net profit and interest income, the sum of which is reduced by the S corporation loss and net operating loss (NOL) deduction from 1994. The AGI is then reduced by the standard deduction and personal exemption. The NOL deduction, excess non-business deduction exceeding non-business income, excess capital losses over capital gains, contributions of a self-employed taxpayer to a self-employed retirement plan and personal exemption are then added back to the taxable loss. the result of which is the NOL.

The precarious position of commercial speech
Article Abstract:
The US Supreme Court ruled in Rubin v. Coors Brewing Co. that the Bureau of Alcohol, Tobacco, and Firearms ruling that Coors could not identify the alcohol content of its beer on the label was a violation of commercial speech protections. The Court applied the Central Hudson test. It found that the law served a significant government interest, to prevent strength wars among beer manufacturers, but the law was struck down because it was overbroad in serving that interest and because little evidence suggested that strength wars were likely.
