Lord Irvine says the Bar's open

Article Abstract:

The UK government aims to ensure that all qualified solicitors and barristers can appear in the higher courts, as long as they have met the appropriate criteria. It is also looking to simplify the approval process for those extended rights of audience. Some observers believe that this development represents a significant threat to the Bar and its future. They fear that there will be excessive competition in the courts. In contrast, Lord Irvine, the Lord Chancellor, believes that this move is necessary if a modern and fair system is to be established.

What price justice?

Article Abstract:

The UK government's Access to Justice Bill aims to boost access to justice and to ensure that the best possible value is obtained from taxpayers' money spent on legal services and court proceedings. A Legal Services Commission will be created, and this will in turn be responsible for setting up a Community Legal Service and ensuring that legal services are matched to the requirements of individual communities. A Community Legal Service Fund will replace legal aid in civil and family cases.
