The criminal prosecutor's roles in assuring quality of care in long term care settings
Article Abstract:
The Pennsylvania Office of Attorney General, a criminal prosecution and investigation agency, has played a vital role in assuring adequate quality of care in long term care settings. The agency thoroughly investigated the corporate entity responsible for death of two nursing home residents due to negligence and criminal mistreatment in 1990. The Statewide Investigating Grand Jury charged the facility with charges of involuntary manslaughter. The prosecution resulted in revision of laws and improvement of care provided at long term facilities. The investigation process of the agency is described.

The Pennsylvania Office of Attorney General and advocates for elderly nursing home residents in Philadelphia have collaborated to ensure residents' protection against injuries and death resulting from lack of adequate care. A law for provision of minimum level of care to long-term residents has been passed. Neglect, mistreatment and lack of appropriate care and services are considered to be felony or misdemeanor cases. Investigations of nursing homes, educational programs and collaboration between the prosecutors and health care professionals are essential for ensuring adequate care delivery.

Consumer views on assuring quality of care: lessons from "The Corporation" case
Article Abstract:
A corporation case involving gross neglect of a nursing home's residents has inculcated awareness among the consumers about the need to monitor the performance and quality of care of nursing homes. Several strategies can help in checking the quality of care provided. Consumers should ensure prompt enforcement of the law in cases of mistreatment or neglect and use alternative legal approaches when required. Social workers, health care professionals, and consumers and their families should immediately report and publicize all cases of patient abuse or neglect.
