Merrill agrees to settle with SEC over Orange County charges

Article Abstract:

Merrill Lynch and Company has agreed to pay a $2 million penalty imposed by the Securities and Exchange Commission to settle a long-standing dispute with Orange County, California investors who were devastated by the county's unprecendented bankruptcy filing. The firm was charged with failing to notify investors of the risks, even though it had information about the county's shaky financial condition. Merrill Lynch previously had settled other claims, including a $437 million payment to Orange County, arising from the same case.

Nevada-based Agribiotech Inc. has hired Merrill Lynch & Co. to help determine the company's future path. After explosive growth in recent years, partly due to the bull market, partly due to its many acquisitions, now the company may be for sale itself. Speculation by some says that this is a sure sign of desperation; others say it could mean a profitable turnaround.
