Adjudication survives its first legal challenge

Article Abstract:

A UK judge upheld the decision of an adjudicator in the first legal test of the UK construction industry's new adjudication system. The case concerned a dispute over payment between groundworkers and contractors. The adjudicator had supported the groundworkers case that the contractors should pay a sum deemed to be due. The contractors opposed the decision of the adjudicator on two accounts, one of these being that the ruling was in breach of natural justice. However, the judge dismissed these two arguments.

Article Abstract:

The legal process in the UK can be extremely complex, with cases often being delayed or adjourned. Even if a judgment is obtained, the whole process may begin again with a Court of Appeal hearing.
